Terms of use
Effective October 27, 2026. These terms govern Songwell, provided by Whitecap Interactive. Questions: info@whitecap.io. By creating an account or using Songwell, you agree to these terms.
Your workspace and your work
You retain ownership of your writing and recordings. You give Whitecap Interactive only the permission needed to store, copy, sync, display, export, back up, and process your content to operate Songwell and provide features you request. This includes sending selected text to OpenAI only after you allow that sharing. We do not claim ownership of your songs or a license to publish them, advertise with them, or train our own models on them.
Accounts and eligibility
Keep your sign-in details secure and provide accurate account information. Invitations are for the person and email address invited. Tell us promptly if you suspect unauthorized access. Songwell is not intended for children under 13. If you are not old enough to enter these terms where you live, a parent or guardian must agree and supervise your use.
Acceptable use
Upload only material you have the right to use and record people only with any permission required by law. Do not use Songwell unlawfully, infringe others’ rights, attempt to access another account, interfere with the service, distribute malware, or evade safety or usage limits. This is a private workspace; it does not provide a public publishing or sharing network.
Beta availability and limits
Songwell is currently an invite-only beta. Features can change, be limited, or be temporarily unavailable. Recording storage and optional AI requests have limits; an upload or request can be refused when those limits are reached. Existing work remains accessible subject to outages and account restrictions. The current beta has no in-app purchases or subscription checkout. Any future paid offering will disclose its price and terms before you choose to buy it.
AI and reference tools
Optional AI tools can make mistakes. Review suggestions before relying on them. They do not establish originality, copyright ownership, or permission to use material. Ordinary writing and recording features work without AI. Dictionary and phrase resources have their own attribution and license notices in the app; those licenses apply to reference material and do not transfer ownership of your private work.
Saving, backups, and deletion
Sync can fail or be delayed, and unsaved or unsynced work may exist only on your device. Keep exports of important work. Recovery backups help us recover from service failures and are not a guarantee of recovery of every edit. See the Privacy policy for data handling and retention. You can delete your account in Settings. Account deletion is permanent for live account data, while retained backups expire under their retention rule. Offline devices, signed-out devices, exports, and personal device backups need the cleanup described in the policy.
Suspension and ending use
You can stop using Songwell at any time. We may restrict accounts to address security, unlawful activity, serious violations, or service abuse. Where practical and lawful, we will give notice and an opportunity to export work before permanently ending access or discontinuing the service. Contact us if you believe a restriction is mistaken.
Service limitations and your rights
To the extent permitted by law, Songwell is provided as available without a promise of uninterrupted service, error-free results, or suitability for every purpose. We do not exclude rights, warranties, remedies, or liability that cannot lawfully be excluded, including applicable consumer rights. These terms do not require arbitration or waive class-action rights.
Apple distribution
For an Apple-distributed app, Apple’s applicable Standard End User License Agreement also applies to your app license. Apple is not the provider of Songwell’s account service or responsible for its support. TestFlight builds are also subject to Apple’s applicable beta testing terms. Contact Whitecap Interactive for Songwell support.
Changes and contact
We will post changes here with an updated effective date and provide notice of material changes where required. Contact info@whitecap.io about these terms, account issues, or rights concerns.
